LGBTQIA+ Divorce

Competent and Professional Legal Counsel For All Texans

In June 2015, the U.S. Supreme Court’s decision in Obergefell v. Hodges affirmed the right of all same-sex Americans to marry. This historic ruling surfaced the issue of same-sex divorce, which is now also a constitutionally recognized right of any Texan who wishes to dissolve a same-sex marriage.

The process for obtaining a same-sex divorce is logistically identical as the divorce process for heterosexual couples. Each spouse must take stock of the divorce-related matters he or she must agree to with the other spouse. Many same-sex spouses now have minor children and must come to an agreement on conservatorship (child custody). And, there is always the question of spousal support (alimony).

Same-sex spouses can undertake a contested divorce or uncontested divorce. Your attorney will be able to help determine the best way to dissolve your marriage efficiently and with as little stress as possible.

Though same-sex marriage has been lawful nationwide for several years now, an unfortunate amount of prejudice and bigotry exists in many places—including Texas. If you’re in need of legal advice, contact Tycha Kimbrough at Kimbrough Legal, PLLC today.
